Terms of use
These terms govern general access to the information site and use of a t-api customer portal provided by an education provider.
1. Scope
These terms apply to the public website t-api.app and customer portals on a t-api subdomain. The provider is Philipp Senn, t-api, 8037 Zurich, Switzerland.
For education providers, their individual contract, DPA, SLA and other agreements take precedence. Portal users may also be subject to their education provider's rules.
2. Service description
t-api provides focused browser interfaces for approved education processes and connects them server-side to the relevant education provider's Tocco instance.
Functions, active modules, support and availability depend on the education provider's configuration and contract.
3. Access and account security
There is no self-registration. Access requires an active personal Tocco login with a unique username, a linked non-archived person and a valid email address for code delivery. Visible processes are determined separately from current Tocco data.
One-time codes, sign-in links, session cookies and calendar subscription URLs are personal and confidential. They must not be shared or used jointly.
4. Acceptable use
The platform may be used only for lawful, authorised education processes. In particular, bypassing permissions, automated scraping, disrupting operations, introducing harmful content and accessing data belonging to other education providers or people are prohibited.
Suspicious access may be blocked and security-relevant events audited to the extent necessary.
5. Data and responsibilities
Tocco remains the leading business system. Education providers are responsible for the lawfulness, quality, approval and maintenance of their Tocco data and for the roles and responsibilities of portal users.
Portal users check entries before saving. Clearly incorrect assignments, personal or business data must be reported to the education provider and not edited outside the intended process.
6. Operations, support and availability
t-api is monitored and maintained under the documented operating model. Maintenance windows, response targets, support routes and any availability commitments arise from the relevant customer contract.
Incidents in customer Tocco, network access or other systems outside t-api's control may restrict portal use.
7. Intellectual property
The platform, its software, design and original content are protected by copyright. Only the necessary, non-transferable right of use is granted for the agreed term.
Rights in Tocco, customer content and other third-party services remain with their respective holders.
8. Liability
To the extent permitted by law, t-api is not liable for indirect loss, lost profit or loss caused by unauthorised use, incorrect customer data or systems outside its control.
Mandatory statutory liability and differing individually agreed liability provisions remain reserved. Public product information is not a contractual service commitment.
9. Privacy
Personal data is governed by the privacy notice and the data protection and processing agreements concluded with the education provider.
Business requests for access and deletion are coordinated through the responsible education provider.
10. Changes
t-api may amend these general terms for future use. Material contract-relevant changes are communicated in good time to the named contacts of affected education providers.
Continued use after the effective date is governed by the applicable contract and law; existing claims remain unaffected.
11. Governing law and jurisdiction
Swiss law applies, excluding private international law and the UN Convention on Contracts for the International Sale of Goods, unless mandatory provisions require otherwise.
The place of jurisdiction, where permitted and not agreed otherwise individually, is Zurich, Switzerland.
